It is hereby acknowledged and agreed that Ashurity and its personnel do not engage in the provision of medical treatment.
Handling and disposal of bio-medical waste (if any) generated at the SoC’s premises is the responsibility of SoC
Ashurity’s role is strictly limited to recording the vitals of the Subject of Care ("SoC") as a health data infomediary, addressing anomalies, and providing associated services as specifically outlined in the various sections of its website and/or platform
Ashurity undertakes that its employees are bound by confidentiality obligations in accordance with the applicable laws prevailing in India.
The Client hereby agrees to indemnify and hold harmless the employees of Ashurity from any breach of confidentiality obligations, to the extent necessary, in favour of the treating medical professionals and insurance providers involved in the Client's care.
The signatory to this Agreement expressly waives any and all claims against Ashurity and its personnel for any medical or other damages, including but not limited to deterioration in health condition or death of the Subject of Care (Soc), arising directly or indirectly from the services provided.
In the case of services for which payments have been made in advance, this Agreement shall automatically terminate upon (i) written notice of termination by the SoC and or nominated by the SoC, or (ii) the death of the SoC, whichever occurs earlier or (iii) in the absence of the foregoing, the Agreement shall be deemed terminated on the date of the last service rendered to the SoC
This Agreement shall be governed by, and construed in accordance with, the laws of the State of Karnataka, India.
Any disputes arising out of or in connection with this Agreement shall be resolved through arbitration conducted in Bengaluru, Karnataka.
Each party shall nominate one arbitrator, and the two nominated arbitrators shall mutually agree upon a third arbitrator to serve as the umpire.
In the event that the parties mutually agree on a single arbitrator, such arbitrator shall solely conduct the proceedings.
The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time.
