If You are using the Platform on behalf of another person (Kith and Kin of Subject of Care), including a senior citizen (Subject of Care -hence for referred as SoC), You represent that You have the necessary authority to do so.

General Terms & Conditions

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name ashurity.com ('Website'), including the related mobile site and mobile application (hereinafter referred to as 'Platform').

Your use of the Ashurity Platform (hereinafter referred to as Platform) and services and tools are governed by the following terms and conditions (Terms of Use) as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, You shall be contracting with the Platform Owner and these terms and conditions including the policies constitute Your binding obligations, with Platform Owner. These Terms of Use relate to your use of our website, goods (as applicable) or services (as applicable) (collectively, 'Services'). User Account and Responsibilities

Account Registration:

To access the services offered by Ashurity, You must register and create an account on the Platform, providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of Your login credentials and for all activities conducted through Your account.

Authorized Access:

You may nominate family members or caregivers (“Kith and Kin”) to access or manage Your account, subject to applicable permissions and restrictions.

Prohibited Conduct:

You agree not to use the Platform:

• • For any unlawful, fraudulent, or harmful purpose;
• • To transmit viruses, malware, or engage in cyber-attacks;
• • To misrepresent identity or impersonate another person;
• • To harass, abuse, or harm others, including Ashurity personnel and or their service providers.
• • In any manner that violates applicable law or third-party rights.

Services Offered

Ashurity provides digital health management and other health management support services, including but not limited to, health records storage, coordination of care, location tracking, service provider interactions, and emergency alerts. We reserve the right to modify, suspend, or discontinue any aspect of the Platform or Services at our sole discretion, with or without notice.

Payment Terms

Some Services may be subject to subscription fees and or one-time payments during onboarding process and or during the service period. You agree to pay all applicable charges as per the pricing communicated through the Platform and or by the company from time- to-time. Payments shall be made through authorized payment gateways and or as specified by the company.

User Content and Data

By submitting or uploading any content, including medical information, images, or documents, You grant Ashurity a non-exclusive, royalty-free, worldwide license to use, reproduce, and process such content for the purpose of providing and improving the Services. You represent that You have the necessary rights and consents to share such data and that it does not infringe upon the rights of any third party.

Third-Party Services

The Platform may include links or integrations with third-party websites, services, or applications. Ashurity is not responsible for the content, functionality, or data practices of any third-party service providers. Use of such third-party services is subject to their respective terms and privacy policies

Intellectual Property

All content, trademarks, software, designs, and other intellectual property on the Platform are the exclusive property of Ashurity or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without prior written consent

Your use of the Platform is also governed by our Privacy Policy, which forms an integral part of these Terms. We are committed to protecting Your personal data in accordance with applicable laws.

Limitation of Liability

To the maximum extent permitted by law, Ashurity shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising out of or in connection with Your use of the Platform or Services. Our total liability to You for any claims arising under these Terms shall not exceed the amount paid by You (if any) in the preceding six (6) months

Termination

Ashurity reserves the right to suspend or terminate Your account and access to the Platform at any time, with or without cause or notice, including for violation of these Terms. Upon termination, all rights granted to You shall immediately cease, and You shall no longer have access to any stored data or Services, subject to applicable data retention policies.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Bengaluru, Karnataka, India

Amendments

Ashurity reserves the right to amend these Terms at any time. Material changes will be notified to You via email or through the Platform. Continued use of the Platform after such changes constitutes Your acceptance of the revised Terms.
